Chinese Employment Laws
 

Managing employment relationships is difficult in most jurisdictions. This task is strongly influenced by local laws and regulations local customs and the established HR management tools of western companies, all of which are often in conflict.  In recent years the legal rules were changed dramatically and enforcement of rules become more common both due to government activity and employee's acquired awareness.  

BenCham, IsCham Beijing and SwissCham are glad to invite you to join a breakfast seminar in which two experts will explain basic concept of the employment law, including the contractual requirements for full-time employees, the limited options for unilateral dismissal of employees, the internal employment rules that can assist employers in creating healthy working environment and the role of trade unions. This last topic is especially relevant due to the new regulations in Beijing.
They will highlight the most important stages of a labor relationship and identify some pitfalls and discuss best practice.
 
Mattias Mueller will give a practical overview over the labor relationship from start to finish, what options there are for various labor contracts and the clauses that are most relevant in order to manage the relationship actively.
 
Wang, Huimin (Laura) will focus on employment contract termination
in China. She will share with the audience what preparation an employer should do in order to terminate an employee, what evidence should be collected and how and what need to be considered when calculating the severance package.

Matthias Mueller

Mr. Mueller is the managing partner of Salans' Beijing office. He specializes in all aspects of corporate law and foreign direct investment, including mergers and acquisitions and restructuring of foreign invested enterprises.  His work focuses on private companies and especially on approaches of corporate governance in industries still restricted from foreign investment in China. He also works in the sector of leasing enterprises and lease finance in China. Matthias structures investments and assists clients in their lobbying efforts with government departments for a broad range of projects. Matthias has been living in China permanently since 2002, and is fluent in German, English, and Mandarin.

Laura Wang

Ms. Wang focuses on corporate matters including mergers and acquisitions, foreign direct investment issues and dispute resolution. Ms. Wang has twelve years of experience including seven years with two US law firms and five years with two law firms in China. Ms. Wang has been working on daily basis with companies HR department and legal department on employment related issue. She is listed in the 2008 and 2009 edition of Asia law Leading Lawyers for her mergers and acquisition expertise.
